Terms of Service
Second Phone Number
Operated by We Up LLC
Effective Date: September 21, 2026
1. Agreement to These Terms
These Terms of Service (“Terms”) form a binding agreement between We Up LLC (“We Up,” “we,” “our,” or “us”) and the person or entity using the Second Phone Number application, websites, and associated services (“Service”).
By affirmatively accepting these Terms, creating an account, purchasing a plan, or using the Service after the Terms are presented, you agree to these Terms and the Acceptable Use Policy. If you do not agree, do not use the Service.
If you use the Service for an organization, you represent that you have authority to bind that organization. “You” then includes both you and the organization.
Our Privacy Policy describes how we process personal information and is incorporated for notice purposes. It does not reduce any non-waivable privacy right.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. You may not use the Service if you are prohibited from doing so by law, are located in a territory where the Service is not offered, or are subject to sanctions or restrictions that prohibit the transaction.
You must provide accurate information when information is requested and must not create an account on behalf of a person who has not authorized you to do so.
3. The Service
The Service may allow users to obtain temporary rights to use one or more telephone numbers, make or receive calls, send or receive messages, receive voicemail, purchase or use credits, and access related features. Features, destinations, number types, carrier support, and availability vary by plan, country, provider, device, and law.
The Service depends on internet connectivity, device capabilities, app marketplaces, carriers, number providers, and other third parties. We may modify a feature, route, carrier, destination, or technical configuration to maintain security, legality, quality, or availability.
4. Limited License
Subject to these Terms, We Up grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the application on devices you own or control for lawful use of the Service.
You may not copy, modify, reverse engineer, decompile, disassemble, derive source code from, sell, lease, sublicense, distribute, or create derivative works from the Service except to the extent a restriction is prohibited by applicable law.
5. Accounts and Account Security
An account may be associated with a device or installation identifier rather than a traditional username and password. You are responsible for maintaining reasonable security over your device, operating-system account, access credentials, recovery information, and active sessions.
You must promptly notify us if you suspect unauthorized access or loss of control. You are responsible for activity you authorize and for failing to take reasonable steps to secure the account, but nothing in these Terms makes you responsible for activity caused solely by our breach of law or failure to use legally required safeguards.
You may not sell, transfer, lease, or share an account except with our written permission.
6. Telephone Numbers
6.1 Limited right of use
A Number is made available for use with the Service; it is not sold to you. Except where applicable law creates a right that cannot be waived, you acquire no ownership interest in a Number.
6.2 Availability and changes
Number availability is not guaranteed. A Number may be changed, suspended, reclaimed, or reassigned when reasonably necessary because of:
- Subscription expiration, cancellation, failed payment, or prolonged inactivity;
- A material violation of these Terms or the Acceptable Use Policy;
- A carrier, provider, regulator, court, or legal requirement;
- Fraud, abuse, security, or safety risk;
- Numbering-plan, inventory, technical, or routing changes; or
- Discontinuation of service in a country, region, or number type.
We provide advance notice where legally required and reasonably practicable. Immediate action may be taken when delay could increase harm, violate law or provider requirements, or compromise an investigation.
6.3 Recycled Numbers and authentication risk
Telephone numbers may have been used by prior subscribers and may later be reassigned. You may receive communications intended for a previous user. You must not represent that a Number has always belonged to you, access another person’s account, or use information intended for a prior holder.
Do not use a Number as the only recovery method for a financial, government, medical, employment, social-media, or other important account. We do not guarantee that third parties will accept virtual or internet-based Numbers for verification, two-factor authentication, or account recovery.
6.4 Porting
Any request to port a Number into or out of the Service is subject to applicable law, carrier rules, identity and account verification, eligibility, fees, and technical availability. Nothing in these Terms waives a legally protected number-portability right.
7. Emergency Services and Service Limitations
The Service is not a replacement for primary mobile or fixed telephone service. Unless We Up expressly informs you in writing that emergency calling is enabled for your account and location, the Service does not support emergency calls or reliably transmit location information to emergency responders.
Do not attempt to contact police, fire, ambulance, coast guard, or another emergency service through the Service. Use a locally available emergency-capable telephone service. You must ensure that anyone who may use your account understands this limitation.
Calls and messages may be delayed, blocked, misrouted, degraded, or unavailable because of internet conditions, device settings, recipient blocking, carrier filtering, destination rules, power outages, provider failure, maintenance, or events outside our reasonable control. We do not guarantee delivery, uninterrupted availability, a particular quality level, or acceptance by any third-party service.
8. Lawful Communications and Required Consent
You are solely responsible for determining whether you have lawful authority and any required consent to contact a recipient, send particular content, record a call, or use a Number for a specific purpose.
You must comply with all applicable calling, texting, telemarketing, consumer-protection, privacy, caller-identification, recording, sanctions, and telecommunications laws. Where consent is required, you must maintain reliable evidence of consent and honor opt-out, do-not-call, revocation, and suppression requests promptly.
You may not use automatic dialing, prerecorded or synthetic voice, bulk messaging, lead-generation campaigns, or high-volume commercial communications unless We Up has expressly authorized the use in writing and you independently satisfy all legal and carrier requirements.
9. Verification Codes and Third-Party Accounts
You may receive a verification or authentication code only for an account, transaction, or service that you are legally authorized to access and only where the relevant third party permits use of a virtual or internet-based Number.
You may not use the Service to evade identity verification, sanctions screening, rate limits, account limits, suspensions, bans, anti-fraud controls, geographic restrictions, or another service’s lawful terms. We do not guarantee that any third party will send or accept a verification code through the Service.
10. Subscriptions, Purchases, and Renewal
Prices, billing periods, included features, trial terms, renewal terms, and applicable taxes are displayed before purchase. A subscription automatically renews only when disclosed at purchase and authorized through the applicable marketplace or payment provider.
You must cancel through the provider that processes the subscription and within the time required to prevent renewal. Deleting the application or deleting a Service account does not itself cancel a marketplace-managed subscription.
Refund requests are governed by applicable law and the rules of the marketplace or payment provider that processed the purchase. Nothing in these Terms limits a mandatory refund or cancellation right.
We may suspend paid features following expiration, failed payment, a reversed transaction, or a chargeback. We may correct an erroneous credit, entitlement, or account balance, but we will not remove a legitimately purchased balance without a lawful or contractual basis.
11. Credits and Promotional Benefits
Credits, bonuses, and promotional benefits are limited contractual rights to use eligible Service features. They are not money, stored value, legal tender, or property, and they cannot be transferred, sold, redeemed for cash, or used outside the Service except where applicable law requires otherwise.
Purchased credits remain available according to the terms displayed at purchase. Promotional or bonus credits may expire on the date disclosed when issued. If no expiration is disclosed for a promotional credit, it will remain available while the account is active and in good standing, subject to lawful account termination and Service discontinuation.
We may revoke credits obtained through fraud, payment reversal, technical error, exploitation, or a material policy violation. We maintain records supporting material balance corrections.
12. “Unlimited” Plans and Fair Use
“Unlimited” calling or messaging means ordinary, lawful, person-to-person use is not billed per individual communication during the applicable subscription period. It does not permit automated, bulk, continuous, call-center, traffic-generation, resale, shared-access, or other abnormal use.
All plans remain subject to supported destinations, carrier and network capacity, anti-spam and fraud controls, reasonable technical limits, and the Acceptable Use Policy. We may investigate abnormal usage and may impose proportionate rate limits, destination restrictions, or temporary suspension when reasonably necessary to protect the Service or comply with provider obligations.
Material fair-use restrictions must be disclosed before purchase. We will not rely on undisclosed arbitrary usage limits to contradict a clear purchase representation.
13. User Content
You retain ownership of content you lawfully submit or transmit. You grant We Up and its service providers a limited, worldwide, non-exclusive license to host, reproduce, transmit, route, format, store, and process that content only as necessary to provide, secure, support, and legally operate the Service.
You represent that you have the rights and permissions necessary to transmit the content and that doing so does not violate law, these Terms, or another person’s rights.
14. Acceptable Use Policy
The Acceptable Use Policy below is incorporated into these Terms. A violation of that policy is a violation of these Terms.
15. Monitoring, Investigations, and Enforcement
Where We Up reasonably believes, based on account activity, technical indicators, complaints, carrier or service-provider notices, legal demands, or other reliable information, that an account presents a fraud, security, legal, safety, or operational risk, We Up may investigate and, to the extent permitted by law:
- Require additional verification;
- Impose rate or destination limits;
- Block, delay, or withhold communications;
- Restrict a feature or credit balance;
- Preserve relevant records;
- Suspend or terminate access;
- Reclaim a Number; or
- Refer conduct to a provider, regulator, court, or law-enforcement authority.
We may act without advance notice where delay could increase harm, violate law or provider obligations, compromise an investigation, or threaten the Service. We are not required to disclose confidential detection methods, thresholds, reports, or information whose disclosure could compromise another person’s rights or an investigation.
Where legally required or reasonably practicable, we will provide notice and a method to request review. You may appeal an enforcement action within 30 days by contacting Flyradarai@gmail.com with relevant facts and evidence. We may decline repetitive, abusive, fraudulent, or inadequately verified appeals.
No refund is due for amounts already consumed or for service lost because of a substantiated material violation, except where applicable law requires otherwise. If a material enforcement action is determined to have been made in error, we will restore access, credits, or an appropriate service adjustment where reasonably possible.
16. Intellectual Property
The Service, software, design, trademarks, logos, documentation, and all related intellectual-property rights are owned by We Up or its licensors. These Terms grant no right to use our names, marks, branding, source code, or proprietary materials except for the limited application license in Section 4.
17. Third-Party Services
The Service may rely on or link to third-party networks, marketplaces, websites, software, or services. We do not control independent third parties and are not responsible for their separate content, conduct, availability, or terms. You must comply with applicable third-party terms when using the Service.
18. Service Changes and Discontinuation
We may update, modify, suspend, or discontinue a feature or the Service for technical, security, legal, commercial, or provider reasons. Where a material change adversely affects an active paid subscription, we will provide notice where reasonably practicable and any remedy required by applicable law.
19. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and uninterrupted or error-free operation.
We do not warrant that every Number, destination, carrier, verification service, call, or message will remain available or function without filtering, delay, reassignment, or interruption. These disclaimers do not exclude a warranty or consumer right that applicable law does not permit us to exclude.
20. Indemnification
To the extent permitted by law, you agree to indemnify and defend We Up, its affiliates, officers, employees, contractors, and service providers against third-party claims, regulatory demands, losses, damages, penalties, and reasonable legal costs arising from:
- Your unlawful or unauthorized use of the Service;
- Your material breach of these Terms or the Acceptable Use Policy;
- Content or communications you transmit;
- Your violation of another person’s rights; or
- Your failure to obtain legally required consent.
This obligation does not apply to the extent a claim results from We Up’s gross negligence, willful misconduct, violation of law, or breach of these Terms. For individual consumers, this section applies only to the extent enforceable under applicable consumer law. If you use the Service for a business, the organization is responsible for use by its authorized personnel.
We may control the defense and settlement of an indemnified claim, provided we do not settle a claim in a manner that admits personal wrongdoing or imposes a non-monetary obligation on you without your consent. You must reasonably cooperate with the defense.
21. Limitation of Liability
To the maximum extent permitted by law, We Up and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, business, opportunity, goodwill, or data, arising from or related to the Service, regardless of legal theory and even if advised of the possibility.
To the maximum extent permitted by law, our total aggregate liability arising from or related to the Service and these Terms will not exceed the greater of:
- The amount you paid for the Service during the 12 months preceding the event giving rise to the claim; or
- USD $50.
The exclusions and cap do not apply to liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of non-waivable statutory rights.
22. Dispute Resolution for United States Users
22.1 Informal resolution
Before filing a claim, either party must send a written notice describing the dispute, requested relief, and relevant account information. The parties will attempt in good faith to resolve the dispute for 30 days. Notices to We Up must be sent to Flyradarai@gmail.com
22.2 Arbitration agreement
Except for matters listed in Section 22.3, a dispute between a U.S. user and We Up arising from or relating to the Service or these Terms will be resolved by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs this arbitration agreement.
The arbitration may be conducted by video, telephone, documents, or in person as provided by the applicable rules. An in-person hearing will take place in the county where the consumer resides unless the parties agree otherwise. Fees will be allocated under the applicable consumer rules, and We Up will pay amounts the rules or applicable law require a business to pay.
The arbitrator may award any individual remedy a court could award, subject to these Terms and applicable law. Judgment may be entered in a court with jurisdiction.
22.3 Exceptions
Either party may bring an eligible individual action in small-claims court. Either party may seek temporary or preliminary court relief necessary to prevent imminent misuse of intellectual property, unauthorized access, fraud, or security harm while arbitration is pending. Nothing in this section prevents a person from reporting a matter to a government agency or prevents an agency from seeking relief.
22.4 Class and jury waiver
To the maximum extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff or class member in a class, collective, coordinated, consolidated, mass, or representative action. The arbitrator may not combine claims of different persons without all parties’ written agreement. Each party waives a jury trial for claims subject to arbitration.
If a final court decision determines that applicable law prohibits waiver of a particular request for public injunctive relief, that request will be decided by the court after individual arbitrable claims are completed.
22.5 Right to opt out
You may opt out of arbitration by sending a signed written notice within 30 days after first accepting these Terms. The notice must include your account identifier or assigned Number, the statement that you opt out of arbitration, and the date. Send it to Flyradarai@gmail.com. Opting out does not affect other Terms or your ability to use the Service.
23. Governing Law and Non-U.S. Users
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that the arbitration provision is governed by the Federal Arbitration Act.
This choice does not deprive a consumer of mandatory protections provided by the law of the consumer’s usual residence. If Section 22 does not apply, the courts of Delaware will have non-exclusive jurisdiction, except where applicable consumer law gives you the right to bring or defend a claim in another court.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
24. Sanctions and Export Compliance
You may not use, export, re-export, transfer, or provide the Service in violation of United States or other applicable sanctions, export-control, or trade laws. You represent that you are not a prohibited or restricted party and will not use the Service for a prohibited end use.
25. Changes to These Terms
We may modify these Terms for legal, security, technical, or business reasons. We will provide reasonable advance notice of a material change through the application, website, or another available account channel.
Where required by law, we will request affirmative acceptance. A change will not retroactively alter the resolution of a dispute that arose before the change without the affected user’s agreement.
26. Termination by the User
You may stop using the Service and request account deletion at any time. Subscription cancellation and account deletion are separate actions. Any provisions that by their nature should survive termination—including payment obligations, intellectual property, indemnification, liability limitations, dispute resolution, and lawful retention—will survive.
27. General Terms
- Assignment: You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, reorganization, sale of assets, or operation of law, subject to applicable consumer rights.
- Force majeure: We are not responsible for delay or failure caused by events beyond reasonable control, including network outages, carrier action, natural disasters, war, civil disturbance, labor disputes, government action, or widespread internet failure.
- Severability: If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions remain effective.
- No waiver: Failure to enforce a provision is not a waiver.
- Entire agreement: These Terms and the incorporated Acceptable Use Policy are the entire agreement concerning use of the Service, except for purchase terms presented at checkout and rights that cannot be waived.
- Headings: Headings are for convenience and do not control interpretation.
- Language: If a translation conflicts with the English version, the English version controls except where local law requires otherwise.
